Switzerland launches impeachment process against attorney general

Switzerland has moved closer to removing Attorney General Michael Lauber from office after a parliamentary panel launched impeachment proceedings against the top Swiss prosecutor relating to his probe of corruption in world soccer.
The judicial committee voted yesterday 13 to 4 to move against Lauber “on suspicion of serious breach of duty”. That is after he answered the panel’s questions about his handling of the investigation of corruption involving soccer body FIFA, Reuters reported yesterday.
Lauber has been accused by anti-corruption campaigners of bungling a fraud trial over payments linked to Germany’s 2006 World Cup, and in March saw his pay cut eight percent by an independent watchdog after it found he told falsehoods and violated prosecutors codes of conduct.
In a related development linked with Lauber, PSG President Nasser Al Khelaifi last month had requested the recusal of the federal prosecutors in charge of his final technical and flawed Swiss case, while also filing a criminal complaint. Al Khelaifi’s request was filed after Lauber had been sanctioned by its Supervisory Authority for lying and various breaches of conduct in connection with the conduct of the various FIFA-related cases.
In addition, Al Khelaifi has also filed a criminal complaint after confidential information pertaining to the file was repeatedly leaked. A criminal investigation for suspicion of breach of official secrecy has been opened against unknown and, for obvious conflict of interest issues, assigned to an extraordinary Prosecutor outside of the Office of the Attorney General. It is currently pending.
Commenting on the developments, lawyers representing Al Khelaifi recently said: “There appears to be a recurring theme regarding the Swiss prosecution’s cases, and our client’s case is no different. As we have said from day one, the prosecution’s recently-submitted secondary charge is manifestly artificial and lacks basis in law or fact. While hearing dates have recently been ear-marked, our client’s position has not changed in any way – this secondary case is completely unfounded, just like the primary case which was dropped. Further, and in the context of the findings against the Swiss Attorney General of lying and breach of conduct, we have requested the recusal of the prosecutors and also filed a criminal complaint in relation to the leaks – making it uncertain whether the case will proceed at all.”
After the vote yesterday, Reuters reported, Andrea Caroni, the committee chairman, told reporters: “The judicial committee opens an impeachment hearing when there is reasonable suspicion the accused willfully or with gross negligence seriously violated his official duties, or otherwise has lost the ability to fulfill them.”
If Lauber is found to have committed a breach, the judicial committee will submit a motion to Swiss parliament to vote on his removal, Caroni said, potentially later this year.
Lauber, Switzerland’s attorney general since 2012, was questioned on Wednesday about alleged inappropriate contacts between his office and FIFA, as well as e-mail correspondence concerning FIFA President Gianni Infantino, Caroni said. Infantino is not accused of wrongdoing.
Lauber’s office took note of the panel’s decision and said he would carry on with his duties during the upcoming process, saying it would not impact the office’s operations.
Lauber, who is appealing the watchdog’s findings against him from earlier this year, is the first Swiss national official to undergo an impeachment process since the foundation of the modern country in 1848.

قرّرت لجنةٌ برلمانيةٌ أمس فتحَ إجراء بشأن عزل المدّعي العالم السويسري مايكل لوبر، المُشتبه في تواطئه مع مواطنه جاني إنفانتينو رئيس الاتحاد الدولي لكرة القدم، بسبب لقاءات غير رسمية جمعت الطرفَين. وصوتت اللجنةُ القضائية التابعة للجمعية الفيدرالية السويسرية لصالح هذا الإجراء بأغلبية 13 صوتًا مقابل أربعة معارضة، حيث قال رئيس اللجنة النائب أندريا كاروني إنّ القرار اتخذ «بسبب الاشتباه في وجود انتهاك لمهام المنصب إما عمدًا أو بسبب إهمال فادح»، وذلك خلال مؤتمر صحفي في مدينة بيرن مقر البرلمان.
وإذا وجدت اللجنة في نهاية الإجراء أنه تمّ تأكيد الشكوك، فسوف تقدم اقتراحًا إلى الجمعيّة الفيدراليّة بعزل لوبر، والتي سيكون القرار النهائي بيدها. أما في حال لم يتمّ تأكيد الشكوك، سيتم إغلاق الإجراء وَفق ما أفاد بيان اللجنة. وأُقيمت جلسة الاستماع خلف أبواب موصدة واستمرت نحو ساعتَين وغادر لوبر قاعة المحكمة مستعجلًا من دون التحدث مع أحد، مُشيرًا فقط إلى أن الأمور «سارت بشكل جيد» قبل أن يستقل سيارة، وَفق ما أفاد مصور فرانس برس. وأفادت تقارير صحفية في الآونة الأخيرة عن عقد إنفانتينو ولوبر سلسلةَ لقاءات غير رسمية أثارت شبهات بشأن تعاطي القضاء السويسري مع الملفات المُتعلقة في كرة القدم وعن تواطؤ محتمل مع الاتحاد الدوليّ. ثلاثة لقاءات مع إنفانتينو
وَفقًا لتقرير صادر عن الهيئة المشرفة لمكتب المدعي العام، فإن لوبر القاضي السويسري البالغ من العمر 54 عامًا والمسؤول عن الإجراءات المتعلقة بفضائح الفساد في الاتحاد الدولي لكرة القدم (الفيفا) منذ مارس 2015، «انتهك العديد من مهام منصبه» من خلال الاجتماع بشكل غير رسمي وفي ثلاث مناسبات، مع إنفانتينو في عامَي 2016 و2017. وتابع التقرير «فشل لوبر مرارًا وتَكرارًا في قول الحقيقة، وتصرّف بطريقة غير عادلة، وانتهك مدونة قواعد السلوك الخاصة بمكتب المدعي العام السويسري، وأعاق تحقيق الهيئة المشرفة لمكتب المدعي العام».
كما، وأشارت الهيئة إلى أنّ لوبر «لا يرى أن أفعاله تسبّب أيّ مشاكل ما يظهر سوءَ فهم لمهنته». وعُوقب لوبر بحسم 8 في المئة من راتبه، وهي عقوبة اعترض عليها أمام المحكمة الإدارية الفيدرالية.
وكان المدّعي العام السويسري مايكل لوبروالمدعين الإتحاديين قد اتهموا ناصر الخليفي الرئيس التنفيذي لمجموعة beIN الإعلامية رئيس نادي باريس سان جيرمان الفرنسي، في قضيته المليئة بالعيوب في المحكمة السويسرية، وقدم الخليفي شكوى جنائية بهذا الخصوص. وكانت حيادية وصلاحية ومصداقية مكتب المدعي العام السويسري محل شكّ كبير بعد الكشف أن المدعي العام الأوّل في سويسرا مايكل لوبر قد عُوقب من قبل هيئة الإشراف في المكتب بسبب الكذب وارتكاب انتهاكات لقواعد السلوك في قضايا مختلفة مُتعلقة بالفيفا.
