CRA Imposes 3.5 Million Qatari Riyals as Financial Sanction on Ooredoo Qatar

Doha: The Financial Sanctions Committee (FSC) at the Communications Regulatory Authority (CRA) has imposed a QR3.5 million financial sanction on Ooredoo Qatar for violating instructions issued by the Authority.
Under Decision No. (1) of 2021, the FSC imposed on Ooredoo Qatar a financial sanction for a total amount of (2,000,000 QAR) two million Qatari Riyals. The sanction results from Ooredoos non-compliance with the rules applicable to access and interconnection between licensed Service Providers, and more specifically to Ooredoo Qatar refusal to grant access to its International Gateway Facilities at Al Khessa Cable Landing Station and Ooredoo Data Center 5.
Under Decision No. (4) of 2021, the FSC imposed on Ooredoo Qatar a financial sanction for a total amount of (1,500,000 QAR) one million five hundred thousand Qatari Riyals. The sanction relates to Ooredoos non-compliance with its obligations to file with the CRA and get the CRA prior approval for tariffs for fixed telecom services and therefore for violating CRAs instructions pertaining to customer protection and for violating the instructions pertaining to anti-competitive practices. Namely, Ooredoos lack of compliance prevents controlling the legality of Ooredoos offers on the fixed telecom market and prevents customers to be informed of offers existing in the market. Ultimately, Ooredoos behavior misleads customers and prevents them from benefiting from the best prices.
The total amount of the financial sanctions resulting from the two decisions of the FSC is (3,500,000 QAR) three million five hundred thousand Qatari Riyals.
It is worth mentioning that the Financial Sanctions Committee was established based on the Cabinet Decision No. (14) of 2020, forming the Financial Sanctions Committee of the CRA. The Committee is meant to impose one or more of the financial sanctions that are set out in Schedule No. (1) enclosed in the Telecommunications Law, on the Licensees, in the event of committing a violation of the provisions of the Telecommunications Law, its Executive Regulation or the decisions and licenses issued in the implementation thereof. Such imposition shall be on behaviors other than those provided for in Chapter sixteen of the Telecommunications Law.

الدوحة: فرضت لجنة الجزاءات المالية بهيئة تنظيم الاتصالات، جزاءات مالية على شركة الاتصالات “Ooredoo Qatar” ، قدرها 3.5 مليون ريال لمخالفتها التعليمات الصادرة عن الهيئة.
وبموجب القرار رقم (1) لسنة 2021، فرضت اللجنة جزاءً مالياً على شركة “Ooredoo Qatar” قدره مليوني ريال قطري، وذلك لعدم امتثال الشركة للقواعد المعمول بها فيما يتعلق بالنفاذ والربط البيني بين مقدمي الخدمات المرخص لهم، وعلى وجه الخصوص بسبب رفض شركة “Ooredoo Qatar” إتاحة إمكانية الوصول إلى مرافقها الخاصة بالاتصال الدولي في محطة هبوط الكابل بالخيسة ومركز بيانات “Ooredoo 5”.
وبموجب القرار رقم (4) لسنة 2021، فرضت اللجنة جزاءً مالياً آخر على شركة “Ooredoo Qatar” قدره مليون وخمسمائة ألف ريال قطري، وذلك لعدم امتثال الشركة بالتزاماتها المتعلقة بتقديم طلب للهيئة للحصول على موافقتها المسبقة على التعريفات الخاصة بخدمات الاتصالات الثابتة، وبهذا خالفت شركة “Ooredoo Qatar” التعليمات الصادرة عن الهيئة والخاصة بحماية المستهلك والتعليمات الخاصة بالممارسات غير التنافسية، وعلى وجه التحديد فإن عدم امتثال شركة “Ooredoo Qatar” يمنع التحقق من شرعية العروض التي تقدمها الشركة في سوق الاتصالات الثابتة، ويمنع العملاء من بقائهم على اطلاع بالعروض المتوفرة في السوق، وبالتالي فإن سلوك شركة “Ooredoo Qatar” يضلل العملاء ويمنعهم من الاستفادة من أفضل الأسعار.
وبحسب القرارين الصادرين عن اللجنة، بلغ إجمالي مبلغ الجزاءات المالية ثلاثة ملايين وخمسمائة ألف ريال قطري.
جدير بالذكر أن لجنة الجزاءات المالية قد تم تشكيلها بناء على قرار مجلس الوزراء رقم (14) لسنة 2020 بتشكيل لجنة الجزاءات المالية بهيئة تنظيم الاتصالات. وتختص اللجنة بتوقيع جزاء أو أكثر من الجزاءات المالية المنصوص عليها في الجدول رقم (1) المرفق بقانون الاتصالات، على المرخص له، في حالة ارتكابه مخالفة لأحكام قانون الاتصالات أو لائحته التنفيذية أو القرارات أو التراخيص الصادرة تنفيذًا له، وذلك في غير الجرائم والعقوبات المنصوص عليها في الفصل السادس عشر من قانون الاتصالات.
