Patients have the right to sue the hospital if trainees attended examination without prior consent

Doha: The views of a number of specialists regarding the legality of the presence of intern doctors – trainee doctors – in clinical examination rooms varied, between those who considered their presence in clinical examination rooms in educational hospitals legal and does not violate the ethics of the medical profession, especially since this profession is based on training and direct education, while others considered it important to obtain permission or consent from the patient to be examined before the examination begins, or permission from the patient’s family if he is underage, considering that obtaining the patient’s permission is subject to professional ethics, maintains the patient’s privacy and confidentiality, and spares the doctor and hospital legal accountability that they may face.

Lawyer Falah al-Mutairi stressed that a patient who is surprised during a clinical examination by the presence of a trained doctor, without asking for his permission, has the right to file a complaint against the hospital even if the hospital is educational, stressing the need to place a sign at the entrance to the educational hospital showing that this hospital is an educational hospital, in addition to informing the patient before the examination begins that a number of trained doctors will be present during the examination for the educational and training purposes while ensuring privacy and confidentiality.

الدوحة: تباينت آراء عدد من المختصين حيال قانونية تواجد أطباء الامتياز –الأطباء المتدربين- في غرف الفحص السريري، بين من يعتبر تواجدهم في غرف الفحص السريري في المستشفيات التعليمية قانونيا ولا يخالف اخلاقيات مهنة الطب خاصة وأنَّ هذه المهنة ترتكز على التدريب والتعليم المباشر، في حين رأى آخرون أنَّ من المهم الحصول على إذن أو تصريح من المريض المُراد الكشف عليه قبل بدء الفحص، أو إذن من ذوي المريض إن كان تحت السن القانونية، معتبرين أنَّ الحصول على إذن المريض يخضع لأخلاقيات المهنة، ويحافظ على خصوصية وسرية المريض، كما أنه يجنب الطبيب والمستشفى المساءلة القانونية التي قد يتعرضان لها.

وأكدَّ المحامي فلاح المطيري إنه يحق للمريض الذي يُفاجأ خلال الفحص السريري بتواجد طبيب متدرب دون إذنه بتحرير بلاغ ضد المستشفى حتى وإن كان المستشفى تعليميا، مشددا على ضرورة نَصب لوحة عند مدخل المستشفى التعليمي تبين أنَّ هذا المستشفى مستشفى تعليمي، إلى جانب إبلاغ المريض قبل بدء الفحص بأن هناك عددا من الأطباء المتدربين سيتواجدون خلال الفحص لأغراض التعليم والتدريب مع ضمان الخصوصية والسرية.
