Penalties for unauthorized photography in public equal to insult and slander

Doha: Legal counsel Ahmed Abdullah Al-Subaie stressed that violation of human freedom and its sanctity, is a subject that became committed daily on social media, explaining that it is a crime among a group of crimes affecting human freedom such as insult, slander and defamation and therefore the legislator put a single penalty regardless of the difference of the act itself.

In an interview with Qatar TV on Monday evening, Al-Subaie said that two major acts of article (333) have been added to Law 4 (4) for 2017, i.e., three years ago, and therefore the scope of criminalization has expanded, but many people do not know when to go beyond and interfere with the freedom of others. “With the spread of social media, awareness of this law has become very necessary, as some do some damage to others without knowing, which never protects them from legal accountability,” he said.

The legal counsel explained that the law prohibits interference in the lives of others, as it criminalizes the filming of a person without prior permission or registration, explaining , in this regard, that filming incidents, for example, is one of the most important crimes that violate privacy and is punishable by law, since taking pictures or clips in a public place with the intention of offending or defamation is punishable by up to two years’ imprisonment and a fine of not more than 1,000 riyals or one of the penalties.

الدوحة: أكد المستشار القانوني أحمد عبدالله السبيعي أن الاعتداء على حرية الإنسان وحرمته، موضوع أصبح يرتكب يوميا على مواقع التواصل الاجتماعي، موضحاً أنها جريمة من بين مجموعة من بين جرائم تمس حرية الإنسان كالسب والقذف والتشهير وبالتالي المشرع وضع لها عقوبة واحدة بصرف النظر عن اختلاف الفعل في حد ذاته .

وأضاف السبيعي – في مقابلة مع “تليفزيون قطر” مساء يوم الاثنين – أنه تم إضافة فعلين رئيسين للمادة (333) بالقانون رقم (4) لسنة 2017 أي منذ 3 سنوات، وبالتالي اتسع مجال التجريم، غير أن الكثير من الناس لا يعرفون متى يتجاوزون ويتدخلون في حرية الآخرين.

وتابع”مع انتشار وسائل التواصل الاجتماعي أصبحت التوعية بهذا القانون ضرورية جدا، حيث إن البعض يقومون ببعض الأضرار للأخرين بغير علم وهو أمر لايحميهم أبدا من المساءلة القانونية”.

وأوضح المستشار القانوني أن القانون يمنع التدخل في حياة الآخرين ، كما يجرم تصوير الشخص دون استئذان مسبق أو التسجيل له، موضحاً – في هذا الصدد – أن القيام بتصوير الحوادث – على سبيل المثال – يعتبر من أهم الجرائم التي تنتهك الخصوصية ويعاقب عليها القنانون ،  حيث أن التقاط صور أو مقاطع في مكان عام بقصد الإساءة أو التشهير، يعاقب عليها القانون بالحبس مدة لا تجاوز سنتين، وبالغرامة التي لا تزيد عن 10000 ريال أو بإحدى العقوبتين.
