Doha: The New Delhi High Court is looking into a lawsuit against Facebook, which owns WhatsApp, accusing the new WhatsApp policies of threatening privacy and public security in India, according to Reuters.
This is the first legal reaction that the court will consider after announcing that the WhatsApp application will share the personal data of its users with Facebook, under threat of losing access to the application if users do not agree to the new terms by February 8th.
The Turkish Competition Council has also launched an extensive investigation against the new policies announced by WhatsApp.
In the petition to the Delhi High Court, lawyer Chaitanya Rohilla argues that the WhatsApp application endangers national security by sharing, transferring and storing users’ data in another country with information governed by foreign laws.
He added that the arbitrary behavior and intimidation followed by the application could not be accepted, as he described it as against democracy and against the basic rights stipulated in India’s constitution, according to Forbes magazine.

ويعد هذا أول رد فعل قانوني، تنظر فيه المحكمة، بعد إعلان تطبيق واتسآب مشاركة البيانات الشخصيّة لمستخدميه مع موقع فيسبوك، تحت طائلة فقدان الوصول إلى التطبيق إذا لم يوافق المستخدمون على الشروط الجديدة بحلول 8 فبراير المقبل.
كما بدأ مجلس المنافسة التركي تحقيقًا موسعاً ضد السياسات الجديدة التي أعلن عنها تطبيق واتساب.
ويقول المحامي تشيتانيا روهيلا في الالتماس المقدم إلى محكمة دلهي العليا إن تطبيق واتساب يعرض الأمن القومي للخطر من خلال مشاركة ونقل وتخزين بيانات مستخدم في دولة أخرى مع المعلومات التي تحكمها قوانين أجنبية.
وأضاف أن السلوك التعسفي والتخويف الذي يتبعه التطبيق لا يمكن قبوله، كما وصفه بأنه ضد الديمقراطية، وضد الحقوق الأساسية المنصوص عليها في دستور الهند، وفق ما ذكرت مجلة فوربس.
