ICC Qatar organized Webinar on Emerging Trends in International Disputes

Doha: The International Chamber of Commerce (ICC) Qatar in collaboration with Crowell & Moring, held a webinar on “Emerging Trends in International Disputes.”

HE Dr. Sheikh Thani bin Ali Al Thani, Member of the ICC Arbitration Court delivered his presentation during the webinar and provided an overview of Qatars increased involvement on the world stage in the area of mediation as a means to resolve an international dispute. He noted that Qatar was one of the first states to sign the UN Convention on International Settlement Agreements Resulting from Mediation, otherwise known as the Singapore Convention on Mediation, which entered into force on Sept. 12, 2020.

HE Dr. Sheikh Thani pointed out that 53 states have signed the Singapore Convention on Mediation, and with more signatories anticipated, there clearly is a growing interest to adopt mediation and conciliation as means of settling international commercial disputes.

Addressing participants, the Partner and co-chair of Crowell & Morings International Dispute Resolution Group Ian Laird highlighted the benefits of mediation international disputes, the issues Qatari companies should consider, and the option to use the ICC Mediation Rules to help increase enforceability of contractual settlements in countries that are signatories to the Singapore Convention.

For her part, Randa Adra, Crowell & Moring Counsel based in New York provided a valuable overview of new amendments to the ICC Arbitration Rules, which will take effect for cases submitted to the ICC after 1 January 2021. She highlighted improvements to the flexibility, transparency and efficiency of ICC arbitrations, especially as the world is seeing and experiencing more virtual proceedings and increasingly complex cases.

الدوحة: عقدت غرفة التجارة الدولية – قطر، بالتعاون مع مكتب /كرول آند مورينغ للمحاماة/ ندوة عبر تقنية الاتصال المرئي بعنوان “الاتجاهات الناشئة في النزاعات الدولية”.

وخلال الندوة، سلط سعادة الشيخ الدكتور ثاني بن علي آل ثاني عضو محكمة التحكيم بغرفة التجارة الدولية، الضوء على اهتمام دولة قطر بالوساطة كوسيلة لحل المنازعات الدولية، وقال سعادته في فيديو مسجل تم عرضه خلال الندوة، إن دولة قطر من أوائل الدول التي وقعت على “اتفاقية الأمم المتحدة بشأن اتفاقات التسوية الدولية المنبثقة من الوساطة” والمعروفة باسم “اتفاقية سنغافورة”، والتي دخلت حيز التنفيذ في 12 سبتمبر 2020، كما أن دولة قطر تعتبر من بين الدول الثلاث الأولى التي صادقت على اتفاقية سنغافورة.

وأشار إلى أن عدد الدول التي وقعت على الاتفاقية حتى آلان بلغ 53 دولة، مشددا على أنه من المتوقع أن ينضم إلى الاتفاقية العديد من الدول خاصة في ظل الاهتمام المتزايد من دول العالم بتبني الوساطة والتوفيق كوسيلة لتسوية المنازعات التجارية الدولية.

من جانبه، استعرض السيد إيان ليرد، الشريك والرئيس المشارك لمجموعة /كرول آند مورينغ/، مزايا الوساطة في حل النزاعات الدولية والأمور التي يجب أن تضعها الشركات القطرية في الاعتبار، وكذلك دور قواعد الوساطة الخاصة بغرفة التجارة الدولية انطلاقا من تعزيز الالتزام بالتسويات التعاقدية في الدول الموقعة على اتفاقية سنغافورة.

بدورها، استعرضت السيدة راندا أدرا مستشارة بمجموعة /كرول آند مورينغ/، التعديلات الجديدة على قواعد تحكيم غرفة التجارة الدولية والتي ستدخل حيز التنفيذ في 1 يناير 2021. كما تناولت مزايا هذه القواعد من حيث المرونة والشفافية والكفاءة، مؤكدة ان العالم يشهد نموا متصاعدا في عدد الدعاوى التي تتم عن بعد.
