MOCI Seizes of 68 Violations of Consumer Protection Law

Doha: The Ministry of Commerce and Industry (MOCI) has announced the seizure of 68 violations of different companies and commercial stores during the inspection campaigns that it recently carried out and included markets in all country’s areas, in order to ensure the extent of compliance with the implementation of Law No. (8) of 2008 regarding consumer protection, and the regulations in force in light of Covid-19 outbreak.

In a statement released by the ministry, 61 of the violations seized were non-compliance with the conditions related to health and safety for the consumer, a violation of Article No. 13 of the Consumer Protection Law No. 8 of 2008, which stated that the supplier shall guarantee the conformity of the commodity or service to the declared and approved standard specifications, and the supplier shall be held liable for non-compliance with the conditions of public health and safety.

The remaining seven violations are related to selling face masks and sterilizers that do not conform to the standard specifications, which is a violation of Article 6 of the same law, which stated that no defective commodity shall be old, displayed, presented, promoted or advertised.

The penalty for violating Law No. (8) of 2008 ranges between administrative closure and financial fines which vary between QR 3,000 and QR 1000,000.

The Ministry noted that these inspection campaigns come within the framework of its keenness to regulate and monitor markets and commercial activities in the country with the aim of controlling prices in order to protect consumers’ rights.

It stressed that it be firm for all those who flout the Consumer Protection Law and its implementing regulations, and that it would intensify its inspection campaigns to follow up and monitor suppliers who are not committed to the laws, and referring those who violates the laws to the competent authorities to take appropriate measures against them.

The Ministry urged all consumers to report any violations via the call center 16001, or by e-mail to infomoci.gov.qa, and the ministry’s accounts on social media, Twitter MOCIQATAR, Instagram, MOCIQATAR, and the MOCIQATAR mobile phone app.

الدوحة: أعلنت وزارة التجارة والصناعة عن ضبط وتحرير 68 مخالفة لشركات ومحال تجارية مختلفة وذلك خلال الحملات التفتيشية التي نفذتها مؤخرا وشملت الأسواق بكافة مناطق الدولة، وذلك للتأكد من مدى التزام المزودين بتنفيذ القانون رقم (8) لسنة 2008 بشأن حماية المستهلك، واللوائح المعمول بها في ظل أزمة انتشار مرض كورونا (كوفيد-19).

وأوضحت الوزارة، في بيان لها، أن 61 مخالفة من المخالفات المضبوطة تمثلت في عدم التقيد بالشروط المتعلقة بالصحة العامة والسلامة للمستهلك، مما يعد مخالفة للمادة 13 من القانون رقم 8 لسنة 2008 بشأن حماية المستهلك، والتي تنص على أن “يضمن المزود مطابقة السلعة أو الخدمة التي يزود بها المستهلك للمواصفات القياسية المعتمدة المعلن عنها، كما يسأل عن عدم التقيد بالشروط المتعلقة بالصحة العامة والسلامة”.

وأشارت إلى أن المخالفات السبع المتبقية تتعلق ببيع أقنعة وجه (كمامات) ومعقمات غير مطابقة للمواصفات القياسية المقررة، وهو ما يعد ذلك مخالفة للمادة 6 من القانون ذاته والتي تنص على حظر بيع أو عرض أو تقديم أو الترويج أو الإعلان عن أي سلعة تكون مغشوشة أو فاسدة وتعتبر السلعة مغشوشة أو فاسدة إذا كانت غير مطابقة للمواصفات القياسية المقررة أو كانت غير صالحة للاستعمال أو انتهت فترة صلاحيتها”.

وتتراوح عقوبة مخالفة القانون رقم (8) لسنة 2008 بشأن حماية المستهلك ما بين الإغلاق الإداري والغرامات المالية التي تبلغ ما بين ثلاثة آلاف ريال إلى مليون ريال.

ونوهت وزارة التجارة والصناعة إلى أن هذه الحملات التفتيشية تأتي في إطار حرصها على تنظيم ومراقبة الأسواق والأنشطة التجارية بالدولة بهدف ضبط الأسعار والكشف عن التجاوزات حفاظا على حماية حقوق المستهلكين.

وأكدت أنها ستقف بحزم في وجه كل من يتهاون بقانون حماية المستهلك ولائحته التنفيذية، أنها ستكثف حملاتها التفتيشية لمتابعة ومراقبة المزودين غير الملتزمين بالقوانين والذين يقومون بتأليب مصلحتهم الخاصة على الصالح العام في هذه الظروف التي تحتاج تكاتف الجميع، مع إحالة كل من يخالف القوانين والقرارات الوزارية إلى الجهات المختصة لاتخاذ الإجراءات المناسبة ضده وذلك حماية لحقوق المستهلكين.

وحثت الوزارة جميع المستهلكين على الإبلاغ عن أي تجاوزات أو مخالفات عبر مركز الاتصال (16001)، أو من خلال البريد الإلكتروني info@moci.gov.qa ، وحسابات الوزارة على مواقع التواصل الاجتماعي توتير MOCIQATAR@، والإنستغرام MOCIQATAR، وتطبيق MOCIQATAR على الهواتف المحمولة.
