US Supreme Court Orders Pennsylvania to Segregate Post-Election Day Ballots

Washington: US Supreme Court Justice Samuel Alito issued an order Friday directing Pennsylvania officials to segregate any mail-in ballots that arrived after Election Day, but ignored Republicans request to stop the state from counting the late-arriving ballots entirely, keeping alive the ongoing challenge to Pennsylvanias mail-in ballot deadline, which was extended by a state court decision to three days after Election Day.
This order is in line with the guidance that secretary of state of Pennsylvania had already issued.
Earlier in the day, Pennsylvania Republicans asked the court to issue the order, suggesting – without evidence that some counties are not following state guidance.
In court papers, lawyers for the state GOP said that “given the results of the November 3, 2020 general election, the vote in Pennsylvania may well determine the next President of the United States – and it is currently unclear whether all 67 county boards of elections are segregating late-arriving ballots,” the GOP petition said.
Alito suggested some frustration that the secretary of state had not kept the Supreme Court aware of changes in guidance.
Pennsylvania Secretary of State Kathy Boockvar has already ordered any ballots that arrive between Nov. 4 and Nov. 6 be segregated from those that arrived by Election Day, pending ongoing litigation, and Alitos order puts more force to that order.
The GOP has sought to halt or delay the ballot count in several lawsuits filed or revived this week around the country since Tuesday. According to court filings, at least 35 lawyers, including newly appointed Republican National Committee “legal challenge teams” in key states, have been drafted by the campaign to bring cases alleging voting irregularities or missteps by election officials in the wake of an election that ran largely smoothly Tuesday.
But judges have responded skeptically as Republicans struggle to provide specific evidence to support Trumps claim of widespread voter fraud, leading them to deny or dismiss claims of irregularities or rule-breaking in Michigan, Georgia and Pennsylvania. Voting rights advocates, election administrators and Democrats have roundly criticized the lawsuits as meritless.
On Thursday, judges in three states rejected lawsuits filed by the Trump campaign that challenged the ballot-counting process. Friday brought additional defeat for Republicans in Michigan, as judges rejected a lawsuit from a conservative nonprofit alleging rules were broken during ballot processing and counting in Detroit, according to lawyers involved in the case. And the GOP had another setback in Nevada, where a judge denied an emergency request to intervene in the vote count in Clark County.

وأفادت قناة /الحرة/ بأن أمر القاضي صموئيل أليتو، يأتي في خضم جدل وخلاف حول بطاقات الاقتراع التي تم استلامها خلال فترة تمديد لثلاثة أيام، صدرت قبل الانتخابات من قبل المحكمة العليا في بنسلفانيا.
وأمر القاضي أليتو، المعين من قبل الجمهوريين ويتولى الأمور الطارئة من ولاية بنسلفانيا، الديمقراطيين بالرد بحلول يوم /السبت/ الساعة الثانية عصرا بتوقيت واشنطن، على طلب الجمهوريين.. وقال إنه “سيحيل الأمر إلى المحكمة العليا لمتابعة الخطوات التالية”.

ونقلت /الحرة/ عن ثلاثة مصادر وصفتها بالمطلعة القول إن “الجمهوريين يحاولون جمع 60 مليون دولار، على الأقل، لتمويل الطعون القانونية التي رفعها ترامب بشأن نتائج الانتخابات الرئاسية الأمريكية”.
ورفعت حملة ترامب سلسلة من الدعاوى القضائية المتعلقة بانتخابات 3 نوفمبر، في عدة ولايات، حيث وسع المنافس الديمقراطي جو بايدن تقدمه واقترب من الفوز بالبيت الأبيض.
ولا يزال ملايين الأمريكيين يترقبون إعلان الفائز في الانتخابات الرئاسية التي أجريت يوم /الثلاثاء/ الماضي.
ولم تعلن أي وسيلة إعلام أمريكية بارزة فوز أحد المرشحين في ولاية /بنسلفانيا/ الواقعة في الشمال الأمريكي الصناعي، والتي تمنح 20 ناخباً كبيراً ، وكان ترامب قد فاز فيها عام 2016.
وفي حال فوز بايدن في ولاية بنسلفانيا، سيُصبح الرئيس الـ46 للولايات المتحدة أيا تكن النتيجة في بقية الولايات.
ويحتاج المرشح في السباق إلى البيت الابيض، إلى غالبية من 270 صوتا في الهيئة الناخبة.. ويحوز بايدن حاليا على 253 صوتا، في مقابل 214 صوتا لترامب.
