Doha: HE Prime Minister and Minister of Interior Sheikh Khalid bin Khalifa bin Abdulaziz Al-Thani chaired Wednesday the Cabinet’s regular meeting held at its seat at the Amiri Diwan.

Following the meeting, HE Minister of Justice and Acting Minister of State for Cabinet Affairs Dr. Issa bin Saad Al Jafali Al Nuaimi said the following statement:

At the outset of the meeting, the cabinet condemned the Israeli government’s decision to build thousands of new settlement units in the occupied West Bank, challenging international law, particularly UN Security Council Resolution no. 2334 issued on December 23 of 2016. The cabinet called on the international community to move swiftly and decisively to stop Israeli settlement activity in occupied Palestinian land, given it is the greatest challenge facing peace, and a great undermining of the two-state solution. The cabinet reiterated the State of Qatar’s firm position of supporting the rights of the Palestinian people, led by their right to establish an independent state on the borders of 1967 with East Al Quds as its capital.

Afterwards, the cabinet was briefed by HE Minister of Public Health on the latest developments in the efforts to contain the spread of the Coronavirus (COVID-19). The cabinet stressed on the importance of precautionary measures in combatting the epidemic.

The cabinet then was briefed on the strategy to combat money laundering, financing terrorism and the proliferation of weapons of mass destruction for 2020 to 2025, which reflects the intensive efforts of national authorities in recent years to protect the financial system of Qatar and the world. The strategy will serve as a roadmap to achieve the state’s ambition of becoming a leader in combatting these crimes. The national strategy is focused on limiting threats related to money laundering and financing of terrorism, in addition to enhancing the capabilities in dealing with the challenges discovered during the national risk assessment process.

The strategy’s goals are:

– Continue investigating local and international financial flow at a strategic level in order to limit related risks.

– Combating illegal financing through investigation, prosecutions, and confiscating the crime’s proceeds.

– Combating illegal financing through effective regulation.

– Enhancing transparency.

– Enhancing the collection and analysis of statistics at a national level.

– Enhancing the capabilities of national authorities in combating illegal financing.

The cabinet directed the authorities designated with combating money laundering, terrorism financing, and financing of weapons of mass destruction, to implement the strategy in order to protect the integrity and safety of the national financial system, which would in turn enhance economic growth by implementing the best international practices in the field.

Then, the Cabinet considered the topics on the agenda as follows:

First- Approval of a draft law on judicial implementation.

The preparation of the draft law comes for the purpose of reorganizing, re-arranging and updating the implementation procedures stipulated in the Code of Civil and Commercial Procedure by Law no. 13 of 1990, in line with the development that the country is witnessing in various fields, as well as benefiting from modern technological means to speed up judicial implementation procedures.

The project is expected to contribute to creating an environment attractive for investment through the speedy implementation of judicial rulings, in addition to contributing to securing the rapid and continuous payment of family expenses, and addressing the phenomenon of issuing checks without balance, given that the check is a direct executive document under which the implementation is carried out without the need to file lawsuits.

Among the provisions included in the draft law are provisions related to the establishment of an independent court where implementation shall take place, as well as the availability of multiple options for conservative and executive measures, the facilitation of procedures, the provision of adequate safeguards for or against the executer and others, and the establishment of a fund for court trusts.

Second- Approval of a ministerial decision prepared by the Ministry of Administrative Development, Labor and Social Affairs to replace Resolution no. 16 for the year 2007 of the Minister of Civil Service Affairs and Housing, regarding limiting the working hours in open workplaces during the summer.

The project has been prepared with the aim of tightening control over the requirements and specifications of health and safety at work in open spaces that are exposed to high temperatures that can cause heat and health stress.

The project included a number of provisions, including limiting working hours for jobs performed under the sun or in open workplaces during the period from June 1 to Sept. 15 annually, and prohibiting work from 10 am to 3:30 pm.

Third- the Cabinet reviewed the following issues and took the appropriate decisions in their regard:

1- The sixth report on the work of the Coordination Committee between the entities working at Hamad International Airport from Apr. 1 to Sept. 30 of 2020.

This Committee, established in the General Authority of Civil Aviation, among other things, is responsible for coordinating work between all the entities working at Hamad International Airport, to facilitate the operations and activities of air transport, as well as the movement of aircraft, passengers, goods and mail to and from the state, in accordance with applicable laws and regulations, and to provide the necessary requirements to facilitate the work of the airport activities.

2- The results of the meeting held on the sidelines of the 75th session of the United Nations General Assembly, on addressing the impact of coronavirus (COVID-19) on future generations, (September of 2020 via videoconferencing).

الدوحة: ترأس معالي الشيخ خالد بن خليفة بن عبدالعزيز آل ثاني، رئيس مجلس الوزراء ووزير الداخلية، الاجتماع العادي الذي عقده المجلس ظهر اليوم بمقره في الديوان الأميري.

وعقب الاجتماع، أدلى سعادة الدكتور عيسى بن سعد الجفالي النعيمي، وزير العدل والقائم بأعمال وزير الدولة لشؤون مجلس الوزراء بما يلي :

في بداية الاجتماع أدان مجلس الوزراء قرار الحكومة الإسرائيلية ببناء آلاف الوحدات الاستيطانية الجديدة بالضفة الغربية المحتلة، في تحد سافر للقانون الدولي وقرارات الشرعية الدولية، وبصفة خاصة قرار مجلس الأمن رقم 2334 الصادر بتاريخ 23 ديسمبر 2016.

وطالب المجلس بتحرك دولي عاجل وحازم لوقف الاستيطان الإسرائيلي في الأراضي الفلسطينية المحتلة، باعتباره من أكبر معوقات تحقيق السلام، ويشكل تهديدا لحل الدولتين، وعقبة أمام استئناف العملية السلمية على أساس القرارات الدولية ومبادرة السلام العربية.

وأكد المجلس مجددا موقف دولة قطر الثابت والداعم للحقوق المشروعة للشعب الفلسطيني، وفي مقدمتها حقه في إقامة دولته المستقلة على حدود عام 1967 وعاصمتها القدس الشرقية.

ثم استمع مجلس الوزراء إلى الشرح الذي قدمه سعادة وزير الصحة العامة حول آخر المستجدات والتطورات للحد من انتشار فيروس كورونا /كوفيد-19/، وأكد المجلس على استمرار العمل بما تم اتخاذه من إجراءات وتدابير احترازية في سبيل مكافحة هذا الوباء.

وبعد ذلك اطلع المجلس على الخطة الإستراتيجية لمكافحة غسل الأموال وتمويل الإرهاب وتمويل انتشار أسلحة الدمار الشامل عن السنوات من 2020 إلى 2025، والتي تعكس الجهود المكثفة التي بذلتها الجهات الوطنية خلال السنوات الأخيرة لحماية النظام المالي لدولة قطر، ومن ثم النظام المالي العالمي من الاستغلال في التمويل غير المشروع، وترسم خارطة الطريق لتحقيق تطلعات الدولة لتصبح من الدول الرائدة إقليميا وعالميا في مكافحة الجرائم ذات الصلة.

وترتكز الخطة الإستراتيجية الوطنية على مخرجات عملية التقييم الوطني للمخاطر في تحديد الأولويات الإستراتيجية لمكافحة التمويل غير المشروع والحدّ من التهديدات والمخاطر ذات الصلة بغسل الأموال وتمويل الإرهاب وانتشار التسلح، وتعزيز الجهود، ورفع مستوى الفعالية لمعالجة التحديات التي تم اكتشافها خلال عملية التقييم الوطني للمخاطر.

وتتمثل الأهداف الإستراتيجية للخطة بما يلي :

– مواصلة التحريات الإستراتيجية بشأن التدفقات المالية المحلية والدولية والحد من المخاطر المرتبطة.

– مكافحة التمويل غير المشروع من خلال التحقيقات والملاحقات القضائية الصارمة ومصادرة متحصلات الجريمة.

– مكافحة التمويل غير المشروع من خلال الرقابة الفعالة وإنفاذها.

– تعزيز الشفافية تجاه المستفيد الحقيقي.

– تعزيز جمع وتحليل الإحصائيات على المستوى الوطني.

– تعزيز قدرات الجهات الوطنية لمكافحة التمويل غير المشروع.

ووجه المجلس الجهات الوطنية المعنية بمكافحة غسل الأموال وتمويل الإرهاب وتمويل أسلحة الدمار الشامل كل فيما يخصه إلى تنفيذ الإستراتيجية وفقاً لما تم وضعه من خطط عمل، لحماية نزاهة النظام المالي الوطني وسلامته بما يضمن فعاليته وازدهاره وتعزيز النمو الاقتصادي، من خلال تطبيق أفضل الممارسات والمعايير الدولية ذات الصلة بمكافحة غسل الأموال وتمويل الارهاب وانتشار التسلح .

كما نظر المجلس في الموضوعات المدرجة على جدول الأعمال على النحو التالي :

أولاً- الموافقة على مشروع قانون بشأن التنفيذ القضائي .

ويأتي إعداد مشروع القانون لغرض إعادة تنظيم وترتيب وتحديث إجراءات التنفيذ المنصوص عليها في قانون المرافعات المدنية والتجارية الصادر بالقانون رقم (13) لسنة 1990، وذلك بما يتفق والتطور الذي تشهده الدولة في شتى المجالات والاستفادة من الوسائل التكنولوجية الحديثة في تسريع إجراءات التنفيذ القضائي .

ومن المنتظر أن يسهم المشروع في خلق بيئة جاذبة للإستثمار من خلال سرعة تنفيذ الأحكام القضائية، وأن يسهم كذلك في تأمين السداد السريع والمتواصل للنفقات الأسرية، ومعالجة ظاهرة تحرير الشيكات بدون رصيد على اعتبار أن الشيك يعد سنداً تنفيذياً مباشراً يتم التنفيذ بمقتضاه دون الحاجة لرفع دعاوى قضائية .

ومن الأحكام التي تضمنها مشروع القانون، أحكاماً تتعلق بإنشاء محكمة مستقلة يتم التنفيذ من خلالها، وإتاحة خيارات متعددة للإجراءات التحفظية والتنفيذية، وتيسير الإجراءات، وتوفير ضمانات كافية للمنفذ ضده وللغير، وإنشاء صندوق لأمانات المحاكم .

ثانياً- الموافقة على مشروع قرار وزاري أعدته وزارة التنمية الإدارية والعمل والشؤون الاجتماعية ليحل محل قرار وزير شؤون الخدمة المدنية والإسكان رقم (16) لسنة 2007، بتحديد ساعات العمل في أماكن العمل المكشوفة خلال الصيف .

وقد تم إعداد المشروع بهدف تشديد الرقابة على اشتراطات ومواصفات الصحة والسلامة في العمل بالأماكن المكشوفة والمعرضة للحرارة العالية التي تسبب الإجهاد الحراري والصحي .

وتضمن المشروع عدداً من الاحكام، منها: تحديد ساعات العمل للأعمال التي تُؤدّى تحت الشمس أو في أماكن العمل المكشوفة خلال المدة من 1 / 6 إلى 15 / 9 من كل عام، وحظر العمل من الساعة العاشرة صباحاً إلى الساعة الثالثة والنصف عصراً .

ثالثاً- استعرض مجلس الوزراء الموضوعين التاليين واتخذ بشأنهما القرار المناسب :

1- التقرير السادس لأعمال لجنة التنسيق بين الجهات العاملة بمطار حمد الدولي عن الفترة من 1 / 4 إلى 30 / 9 / 2020 .

وتختص هذه اللجنة المنشأة في الهيئة العامة للطيران المدني، من بين ما تختص به، بتنسيق العمل بين جميع الجهات العاملة بمطار حمد الدولي، لتسهيل عمليات وأنشطة النقل الجوي وحركة الطائرات والركاب والبضائع والبريد من وإلى الدولة، وذلك وفق القوانين والأنظمة المعمول بها، وتوفير المتطلبات اللازمة لتسهيل وتيسير العمل بأنشطة المطار .

2- نتائج الاجتماع الذي عقد على هامش الدورة (75) للجمعية العامة للأمم المتحدة، حول النظر في تأثير فيروس كورونا /كوفيد-19/ على الأجيال القادمة (سبتمبر 2020- عبر تقنية الاتصال المرئي) .
