Training Course Organized for 4th Batch of Qatari Real Estate Brokers

Doha; The Ministry of Justice’s Legal and Judicial Studies Centre launched today a specialized training course for the 4th batch of Qatari real estate brokers, within the framework of licensing procedures under the provisions of Law No. 22 of 2017 regulating real estate brokerage.
The course aims to provide participants with the necessary information and skills to apply the provisions regulating real estate brokerage business in Qatari law by explaining the general provisions of real estate brokerage and the competent authority to regulate and control them as well as the provisions for licensing the practice of real estate brokerage and licensing procedures.
It also aims to introduce the rights and obligations of the real estate broker and the rules for disciplinary and criminal accountability, explain the general basis of brokerage or mediation contracts and the provisions related to them, and introduce the broker’s obligations in the field of combating money laundering and terrorist financing.
To deepen the participants understanding of the general objectives of the course, the course was divided into several axes, which were based in their entirety on the provisions of Law No. 22 of 2017 regulating real estate brokerage, the Qatari companies law promulgated by Law No. 11 of 2015, Law No. 6 of 2014 regulating Real Estate development, and civil code law issued by Law No. 22 of 2004, and the combating money laundering and terrorism financing law promulgated by Law No. 20 of 2019.
These axes deal with several important topics, including general provisions for real estate brokerage, the rights and obligations of the real estate broker, and the pillars and provisions of the mediation contract.
The course also reviews the definition of real estate brokerage and real estate broker in Qatari law, the organizational structure of the real estate brokerage department and its terms of reference, the real estate brokers affairs committee and the specializations entrusted to it, the general conditions for granting licenses to practice the profession of real estate brokerage, the procedures for obtaining it and the rules of grievance.
The course comes within the framework of the procedures initiated by the real estate brokerage affairs department at the Ministry of Justice to promote the real estate brokerage profession and to regulate the granting of licenses in the local market.
The department organizes training and qualification courses for brokers who have completed a registration on the real estate brokerage webpage that was launched earlier on the ministry’s website, and their files conformed with the conditions and requirements for granting a license in accordance with the provisions of the law.

الدوحة: بدأت بمركز الدراسات القانونية والقضائية بوزارة العدل اليوم، أعمال الدورة التدريبية التخصصية لصالح الدفعة الرابعة من الوسطاء العقاريين، وذلك في إطار إجراءات الترخيص لهم بموجب أحكام القانون رقم 22 لسنة 2017 بتنظيم أعمال الوساطة العقارية.
وتهدف الدورة إلى إكساب المشاركين المعلومات والمهارات اللازمة لتطبيق الأحكام المنظمة لأعمال الوساطة العقارية في القانون القطري من خلال بيان الأحكام العامة للوساطة العقارية والجهة المختصة بتنظيمها والرقابة عليها، وبيان أحكام الترخيص بمزاولة أعمال الوساطة العقارية وإجراءات الترخيص.
كما تهدف الدورة إلى التعريف بحقوق والتزامات الوسيط العقاري وقواعد مساءلته تأديبيا وجنائيا، وبيان الأركان العامة لعقود السمسرة أو الوساطة والأحكام الخاصة بها، والإحاطة بالتزامات الوسيط في مجال مكافحة غسل الأموال وتمويل الإرهاب.
ولتعميق الفهم لدى المشاركين بالأهداف العامة للدورة، تم تقسيم محاور الدورة إلى عدة محاور استندت في مجملها على أحكام القانون رقم 22 لسنة 2017 بتنظيم أعمال الوساطة العقارية، وقانون الشركات القطري الصادر بالقانون رقم 11 لسنة 2015، والقانون رقم 6 لسنة 2014 بتنظيم التطوير العقاري، والقانون المدني الصادر بالقانون رقم 22 لسنة 2004، وقانون مكافحة غسل الأموال وتمويل الإرهاب الصادر بالقانون رقم 20 لسنة 2019.
وتتناول هذه المحاور عددا من المواضيع الهامة، تشمل الأحكام العامة للوساطة العقارية، وحقوق والتزامات الوسيط العقاري، وأركان وأحكام عقد الوساطة.
كما تستعرض الدورة تعريف الوساطة العقارية والوسيط العقاري في القانون القطري، والهيكل التنظيمي لإدارة الوساطة العقارية واختصاصاتها، ولجنة شؤون الوسطاء العقاريين والاختصاصات المنوطة بها، والشروط العامة لمنح التراخيص بمزاولة مهنة الوساطة العقارية، وإجراءات الحصول عليها وقواعد التظلم.
ويأتي تنظيم هذه الدورة في إطار الإجراءات التي بدأتها إدارة الوساطة العقارية بوزارة العدل للارتقاء بمهنة الوساطة العقارية وتنظيم منح التراخيص بالسوق المحلي، حيث تنظم الإدارة دورات تدريبية وتأهيلية للوسطاء اللذين أكملوا التسجيل بصفحة الوساطة العقارية التي تم إطلاقها في وقت سابق على الموقع الإلكتروني للوزارة، وجاءت ملفاتهم متطابقة مع شروط ومتطلبات منح الترخيص وفقا لأحكام القانون.
