For those stranded outside Qatar .. Find out what your current position is on registering the national address

As the deadline for registering the national address data expired on Sunday (July 26th), many residents stranded outside Qatar due to the circumstances of the Corona pandemic, who were unable to register, are wondering about their current position.

The official Twitter account of the Qatar Government’s twitter portal confirmed in response to a tweet about the solutions available to this group, that “when you return, God willing, a person can bring proof of his presence abroad at this time.”

Lt. Col. Abdullah Zayed Al-Sahli, head of the National Address section of Public Security, said in earlier remarks to Qatar TV that there will be flexibility in registration for those caught up in the Corona virus pandemic and will be registered after returning to the country.

** Fine of 10,000 riyals for those who failed to register

Article 6 of the National Address Act stipulates that anyone who violates any of the provisions of articles 3 and 4 of the Act (relating to the obligation to provide the official with the data of the national address to the competent authority, notify it of any modification or change) shall be punished by a fine of not more than 10,000 riyals, or deliberately to inform the competent authority of incorrect data about his national address.

** A paradigm shift

It is expected that the national address will make a qualitative shift by moving from traditional correspondence to digital correspondence to serve all citizens and residents in their dealings with various governmental and non-governmental entities.

As a whole, this law represents a paradigm shift in the conduct of judicial proceedings, as every person in Qatar, a citizen or natural or legal resident, will have a national address. The objectives and advantages of the national address are to contribute to greater security stability by providing security services such as emergency, ambulance and civil defence as soon as possible.

** Judicial announcements

On the other hand, the Ministry of Interior announced on Monday the identification of the national address data approved for the conduct of judicial declarations, after reviewing law No. (24) for 2017 on the national title, especially article (2) the last paragraph and article (3) of it.

The ministry said on its Twitter account that ” after reading law No. (24) for 2017 on the national address and in particular article (2) the last paragraph and article 3 of it, and the decision of the Minister of Interior No. (96 for 2019) to implement some provisions of Law No. (24) for 2017 on the national address and after coordination with the Supreme Council of the Judiciary”, determines the national address data adopted to conduct judicial declarations as follows: A text message on the mobile phone number, a paper ad on the address of the residence, a paper ad on the address of the work, or a paper ad at the permanent address abroad (if any) in the event that the final departure of the country is confirmed.

The Ministry noted that if the commissioned did not submit his national address to the competent authority, the judicial declarations on this body were considered valid and productive for all their legal implications.

مع انتهاء مهلة تسجيل بيانات العنوان الوطني، أمس الأحد 26 يوليو، يتساءل العديد من المقيمين العالقين خارج دولة قطر بسبب ظروف جائحة كورونا، والذين لم يتمكنوا من التسجيل، عن موقفهم الحالي.

الحساب الرسمي لبوابة حكومة قطر الإلكترونية “حكومي” في تويتر، أكد في إجابته على سؤال أحد المغردين حول الحلول المتاحة لهذه الفئة، أنه “عند العودة بإذن الله يمكن للشخص إحضار ما يثبت تواجده خارج البلاد في هذه الفترة”.

وقال المقدم د. عبدالله زايد السهلي، رئيس قسم العنوان الوطني بالأمن العام، في تصريحات سابقة لتلفزيون قطر، إنه سوف تكون هناك مرونة في التسجيل بالنسبة للعالقين بسبب جائحة فيروس كورونا وسوف يتم تسجيلهم بعد العودة إلى البلاد.

** غرامة 10 آلاف ريال للمتخلفين

نصت المادة 6 من قانون العنوان الوطني على أنه يعاقب بالغرامة التي لا تزيد عن 10 آلاف ريال كل من خالف أيا من أحكام المادتين (3) و (4) من القانون ( تتعلقان بوجوب تقديم المكلف بيانات العنوان الوطني للجهة المختصة، وإخطارها بأي تعديل أو تغيير يطرأ عليها)، أو تعمد إبلاغ الجهة المختصة ببيانات غير صحيحة عن عنوانه الوطني.

** نقلة نوعية

ومن المنظر أن يحدث العنوان الوطني نقلة نوعية من خلال الانتقال من المراسلات التقليدية إلى المراسلات الرقمية بما يخدم جميع المواطنين والمقيمين في تعاملاتهم مع مختلف الجهات الحكوميّة وغير الحكوميّة.

ويشكّل هذا القانون في مجمله نقلة نوعية في سير الإجراءات القضائية والعدلية، حيث سيصبح لكل شخص في دولة قطر، مواطنًا أو مقيمًا طبيعيًا أو معنويًا، عنوان وطني. وتتمثل أهداف ومزايا العنوان الوطني في الإسهام في تحقيق المزيد من الاستقرار الأمني بتقديم الخدمات الأمنية مثل الطوارئ والإسعاف والدفاع المدني في أسرع وقت ممكن.

** إعلانات قضائية

من جهة أخرى أعلنت وزارة الداخلية اليوم الاثنين عن تحديد بيانات العنوان الوطني المعتمدة لإجراء الإعلانات القضائية، وذلك بعد الاطلاع على القانون رقم (24) لسنة 2017 م بشأن العنوان الوطني وبخاصة المادة (2) الفقرة الأخيرة و المادة (3) منه.

وقالت الوزارة على حسابها بموقع تويتر إنه ” بعد الإطلاع على بعد الاطلاع على القانون رقم (24) لسنة 2017 م بشأن العنوان الوطني وبخاصة المادة (2) الفقرة الأخيرة و المادة (3) منه، وعلى قرار وزير الداخلية رقم (96 لسنة 2019 بتنفيذ بعض أحكام القانون رقم (24) لسنة 2017 بشأن العنـوان الوطنـي وبعـد التنسيق مع المجلس الأعلى للقضاء”، تحدد بيانات العنوان الوطني المعتمدة لإجراء الإعلانات القضائية على النحو الآتي: رسالة نصية على رقم الهاتف الجوال، أو إعلان ورقي على عنوان السكن، أو إعلان ورقي على عنوان العمل، أو إعلان ورقي على العنوان الدائم في الخارج ( إن وجد) في حال ثبوت المغادرة النهائية للبلاد.

وأشارت الوزارة إلى مراعاة أنه في حال عدم تقديم المكلف عنوانه الوطني للجهة المختصة، اعتبرت الإعلانات القضائية على هذه الجهة صحيحة ومنتجة لكافة آثارها القانونية.
