Cyber fraud: Here are the most prominent lawsuits before the courts

Doha: The ease of trading of technology and the proliferation of modern online applications are undoubtedly behind the increase in fraud cases, with courts considering numerous cyber fraud claims resulting from fictitious companies or individuals running online activities without a license.

Many of these companies are also using modern technology to attract advertisers and consumers of non-compliant goods, and here are the most prominent cyber fraud cases before the courts:

The judiciary considered an advertising promotion case without a license from the competent authority, and found that the ad specified working hours and working days, and contained marketing data on discounts and promotions by distributing gifts without a license.

According to the judgement, the promotional advertisement did not include the distribution of immediate gifts for a service except specific terms for specific days and hours at cost or free of charge without being accompanied by immediate gifts, and here the elements of the crime charged against the accused were not available to the shop and its owner in violation of the offence and the court acquitted them of the charge against them.

Secondly, the Public Prosecutor’s Office accused a company of entering a shipment of cigarettes without obtaining a written license and evaded payment of customs duties, and the misdemeanor court fined the accused 739,000 riyals and confiscated the seizures.

Before the Court of Appeal, the Judicial Circuit overturned the appeal and again fined the accused 739,000 riyals.

Third: the Court of First Instance issued a criminal order to fine a person who had made an advertisement before obtaining a license from the competent authority.

Fourth: The Court of First Instance punished a person who took advantage of Twitter and Snapchat accounts to post topics and videos without prior permission from the concerned party, and provided lessons through these accounts.

لاشك أن أنّ سهولة تداول التكنولوجيا وكثرة التطبيقات الإلكترونية الحديثة وراء ازدياد قضايا الاحتيال، حيث تنظر المحاكم في العديد من دعاوى الاحتيال الإلكتروني التي تنجم عن شركات وهمية أو أفراد يديرون أنشطة عبر الإنترنت بدون ترخيص.

كما أن الكثير من هذه الشركات يستغل التقنية الحديثة في جذب معلنين ومستهلكين لسلع غير مطابقة للمواصفات، وفيما يلي نستعرض أبرزدعاوى احتيال إلكتروني أمام المحاكم:

ـ نظر القضاء في دعوى ترويج إعلاني بدون الحصول على ترخيص من الجهة المختصة، وتبين أنّ الإعلان يحدد ساعات العمل وأيام العمل، ويحوي بيانات تسويقية عن تخفيضات وعروض ترويجية عن طريق توزيع هدايا دون ترخيص.

وجاء في حيثيات الحكم أنّ الإعلان الترويجي لم يشتمل على توزيع هدايا فورية للحصول على خدمة سوى عبارات محددة عن أيام وساعات محددة بمقابل أو مجاناً دون أن تكون مصحوبة بتقديم هدايا فورية، وهنا لم تتوافر أركان الجريمة المسندة للمتهمين المحل ومالكه بما ينتفي معه وقوع الجرم وتقضي المحكمة ببراءتهما من التهمة المسندة إليهما.

ـ ثانياً: اتهمت النيابة العامة شركة بإدخال شحنة من السجائر دون الحصول على ترخيص كتابي بذلك وتهربت من دفع الرسوم الجمركية، وقضت محكمة الجنح بتغريم المتهمة 739 ألف ريال ومصادرة المضبوطات.

وأمام محكمة الاستئناف قضت الدائرة القضائية بإلغاء الحكم المستأنف والحكم مجدداً بتغريم المتهمة مبلغاً وقدره 739 ألف ريال.

ـ ثالثاً: أصدرت المحكمة الابتدائية أمراً جنائياً بتغريم شخص وضع إعلاناً قبل الحصول على ترخيص من الجهة المختصة.

ـ رابعاً: عاقبت المحكمة الابتدائية شخصاً استغل حسابيّ التويتر والسناب شات في نشر موضوعات ومقاطع فيديو بدون إذن مسبق من الجهة المعنية، وقدم عبر هذين الحسابين دروساً.
