No modification of villas without permission: Ministry
وزارة البلدية تحذر من تعديل الفلل دون إذن
Doha: Ministry of Municipality and Environment warned of legal action against residents making modifications to villas without permission.
The ministry noted that modifications on villas without obtaining the necessary licenses and approvals may expose the owner to legal liability in accordance with the applicable laws.
It added that officials have noted recently that certain owners of villas made planning adjustments to the villa by adding partitions or modifying walls or amendment of entrances without obtaining necessary licenses and approvals from the competent authority.
According to the text of the first article of Law No. (4) of 1985 regarding the organization of buildings and its amendments, stipulates that it is not permissible to construct a building or establish a business or expand or extend it or support or maintain it or change the features of any real estate except after obtaining a license to do so from the competent municipality.
The Ministry urged owners of villas to comply with the planning requirements and get prior approvals from the building licenses in order to avoid exposure to legal accountability.
حذرت وزارة البلدية والبيئة من اتخاذ إجراءات قانونية ضد السكان الذين يقومون بإجراء تعديلات على الفلل دون إذن.
ولاحظت الوزارة في تغريدة لها على صفحتها الرسمية بموقع التواصل الاجتماعي تويتر أن التعديلات على الفلل دون الحصول على التراخيص والموافقات اللازمة قد تعرض المالك للمسؤولية القانونية وفقًا للقوانين المعمول بها، قائلة:” تهيب وزارة البلدية والبيئة بالسادة ملاك الفلل الخدمية ضرورة التقيد بالاشتراطات التخطيطية والموافقات الرسمية حسب رخص البناء المعتمدة بعدم إجراء أي تعديلات تخطيطية على المبنى دون الحصول على التراخيص والموافقات اللازمة من البلدية المعنية، وذلك تجنبا للمساءلة القانونية”.
ويشار إلى أن بعض الفلل قامت مؤخرا بإجراء تعديلات تخطيطية على الفيلا عن طريق إضافة أقسام أو تعديل الجدران أو تعديل المداخل دون الحصول على التراخيص والموافقات اللازمة من السلطة المختصة.
وفقًا لنص المادة الأولى من القانون رقم (4) لسنة 1985 بشأن تنظيم المباني وتعديلاته، ينص على أنه لا يجوز إنشاء مبنى أو إنشاء عمل تجاري أو توسيعه أو تمديده أو دعمه أو صيانته أو تغيير ميزات أي عقار إلا بعد الحصول على ترخيص للقيام بذلك من البلدية المختصة.
وحثت الوزارة أصحاب الفلل على الامتثال لمتطلبات التخطيط والحصول على الموافقات المسبقة من رخص البناء لتجنب التعرض للمساءلة القانونية.
