Qatar International Court hosts Seminar on its Expanded Jurisdiction

Doha: The Qatar International Court and Dispute Resolution Centre (QICDRC), in alliance with Lexis Nexis Middle East, hosted today a seminar on the Courts newly expanded jurisdiction into Qatar Free Zones.

Led by Christopher Grout, Registrar at Qatar International Court, and Huw Davies, Senior Legal Counsel at Qatar Free Zones Authority (QFZA), the seminar discussed how Qatars Law No. 15 of 2021 impacts QICDRC, what these amendments mean for companies doing business within Qatar Free Zones, and which exemptions apply.

Grout commented on the seminar: “The expansion of the Courts jurisdiction to include the resolution of Free Zone related disputes is a significant milestone in the development of the Court and, more importantly, is a testament to its reputation and standing as a credible judicial institution within the State of Qatar. Over the last 10 years, the Court has demonstrated its ability to resolve disputes arising out of the Qatar Financial Centre efficiently, cost-effectively and, most importantly, justly, applying, as it does, international best practices. The Court will now do the same for any new disputes filed before it as a result of its increased jurisdiction.”

A decade after QICDRCs establishment, the expansion gives the Court full jurisdiction to decide all matters and disputes pertaining to the Qatar Free Zones, including appeals relating to a decision to revoke or suspend the licenses of registered companies operating within the Qatar Free Zones.

الدوحة: استضافت محكمة قطر الدولية ندوة قانونية ناقشت فيها توسيع اختصاصها القضائي ليشمل هيئة قطر للمناطق الحرة، بالتعاون مع شبكة /ليكسيس نيكسيس/ القانونية، بحضور عدد من أهل الاختصاص في القانون والجهات ذات العلاقة.

شارك في الندوة كل من السيد كريستوفر جراوت، رئيس قلم محكمة قطر الدولية، والسيد هيو ديفيز، المدير التنفيذي للشؤون القانونية لهيئة المناطق الحرة، حيث ناقشوا توسيع اختصاص المحكمة ودورها الجديد في النظر في النزاعات الناشئة من المناطق الحرة وذلك بموجب القانون رقم 15 لسنة 2021، وأثر ذلك على الشركات والكيانات والأفراد العاملين تحت مظلة الهيئة.

وقال السيد جراوت، رئيس قلم المحكمة بهذه المناسبة: “إن توسيع اختصاص المحكمة ليشمل هيئة المناطق الحرة، يعكس ثقة المشرع القطري بكفاءة المحكمة ودورها المهم ضمن المنظومة القضائية في الدولة”.

وأشار إلى أنه على مدى العقد المنصرم، أظهرت المحكمة فعالية وكفاءة نظامها القضائي في النظر في النزاعات الناشئة ضمن مركز قطر للمال، وذلك من خلال تطبيقها لأفضل الممارسات الدولية مما يضمن تحقيق العدالة الناجزة بشكل فعال من حيث الوقت والتكلفة، منوها بأن المحكمة ستواصل الارتقاء بخدماتها القضائية مما يضمن جودة خدماتها ومواكبة مع توسيع اختصاصها القضائي.

ويأتي القانون الجديد بعد إكمال المحكمة لعشر سنوات منذ إنشائها، حيث يمنح القانون الجديد المحكمة توسيع اختصاصها ليشمل جميع النزاعات الناشئة ضمن مظلة هيئة المناطق الحرة، بما في ذلك الطعون المقدمة ضد القرارات الصادرة من الهيئة سواء في ما يخص سحب أو إبطال رخص مزاولة العمل للشركات المسجلة فيها.
