Supervisory Committee Holds Forum for Candidates of the Shura Council

Doha: The Supervisory Committee for the Shura Council Elections held Wednesday a forum for candidates of the Shura Council aimed at promoting the awareness of the electoral process in its legal and organizational aspects.

The forum, attended by candidates registered in the preliminary lists, shed light on the legal and organizational procedures related to electoral campaigning and its requirements as regulated by law; and provided an explanation of some procedures related to the polling day and the requirements of the committee monitoring spending on electoral campaigning.

Members of the Supervisory Committee listened to all the questions and inquiries raised by the candidates and provided adequate answers to all questions.

Vice-Chairman of the Supervisory Committee for the Shura Council Elections Brigadier-General Salem Saqr Al Muraikhi stressed the significance of this important national entitlement, indicating the Committee’s keenness on providing all facilities to candidates and voters for the elections to be achieved in the fullest manner.

Brigadier-General Al Muraikhi noted the direction of HE Prime Minister and Minister of Interior Sheikh Khalid bin Khalifa bin Abdulaziz Al-Thani to the Committee to carry out its role in responding to candidates, listening to them and clarifying all procedures related to the electoral process.

On the election procedures, Al Muraikhi explained that according to the law, each electoral district has a committee called the “election committee” formed under the chairmanship of a judge chosen by the Supreme Judiciary Council, and two members, one from the Ministry of Interior and the other from the Ministry of Justice.

The committee is responsible for conducting the polling process, counting the votes and announcing the result at the electoral district headquarters.

He added that the law also stipulates that the election is a personal right, and it is not permissible to delegate it. Every voter must exercise his electoral right himself at the electoral headquarters of his electoral district. The law also stipulates that the election should be by direct secret general ballot.

Vice-Chairman of the Supervisory Committee Brigadier-General Salem Saqr Al Muraikhi outlines a set of procedures related to the election day, challenging the validity of the elections, and other procedures related to this matter. 

On the other hand, Head of the Media Section of the Supervisory Committee Brigadier Abdullah Khalifa Al Muftah reviewed the controls of the election campaigns in accordance with the legal texts. He explained that the law specified the period for practicing electoral campaigns to start after the announcement of the final lists of candidates and to end twenty-four hours before the start of the election process.

He cautioned that it is not permissible to conduct election campaigns in a period other than the aforementioned period, and that the maximum expenditure for each candidate in the election campaign is two million Qatari riyals, adding that the municipalities will determine the places for placing advertisements, posters or electoral statements, and will allocate equal spaces in these places for candidates.

According to the law, the candidate is obliged when practicing electoral campaigning to respect the provisions of the constitution, respect the freedom of others to express their opinion, maintain national unity and the security of society, and not conduct any electoral campaign that involves deceiving voters or using the method of defamation or defamation of others, Brig. Al Muftah stressed.

He also cautioned against using the official state emblem or its symbols in meetings, advertisements, electoral bulletins, and all kinds of writings and drawings used in electoral campaigns.

Other controls mentioned by Brig. Al Muftah include that means of electoral campaigning must not be similar to traffic signs and banners or other official signs in terms of the size, shape and colors; not violate the heights, measurements or dimensions determined by the competent municipalities; not obstructs the movement of traffic or pedestrians, or leads to blocking or disabling the functions of traffic lights or obstructing rescue means.

In addition, a written approval must be obtained from the property owner or his representative if the advertising means will be installed on real estate not owned by the candidate; and its must not pose a danger to the users of the property or disturb their comfort.

Other the controls set by the law stipulates that the installation of the electoral advertising means should not cause any damage to public utilities, or endanger the lives of individuals or property, or conflict with the aesthetic character of the area or disturb the public view, Brig. Abdullah Khalifa Al Muftah added.

On the prohibitions of electoral campaigning, Brig. Abdullah Khalifa Al Muftah indicated that the law stipulates a number of prohibitions when practicing electoral campaigning, such as including any tribal or sectarian tendencies or what contradicts public morals, prevailing traditions or religious and social values of the community.

The law also stipulates the prohibition of offending any other candidate, inciting tribal or sectarian strife among citizens in any way, exploiting state-owned means and tools in electoral campaigns, and infringing on others electoral campaigns in any way, whether by cross-cutting, tearing, sabotaging or blocking.

He added that the candidate is prohibited from organizing and holding electoral meetings, giving speeches or placing posters, advertisements or pictures in places of worship, religious centers, educational facilities, government facilities, and facilities and buildings of an archaeological or historical nature and the surrounding fences.

The candidate is also prohibited from organizing and holding electoral meetings, giving speeches, or placing posters, advertisements or pictures inside the election hall or outside the electoral district at a distance of less than two hundred meters. The candidate is also prohibited from placing posters, advertisements or pictures on trees, plant containers, directional signs or traffic signals.

According to the law, loudspeakers are not allowed for electoral campaigning purposes without a license from the competent municipality, provided that the places and times specified in the license are observed.

Brig. Al Muftah added that Article (27) stipulates that it is not permissible for any of the employees in ministries and other government agencies and public bodies and institutions to carry out any election campaigning during the course of their work or their official working hours.

Meanwhile, Brig. Al Muftah noted that the candidate must remove electoral advertisements, posters, flyers, and any means of electoral propaganda within three days from the date of the end of the electoral process.

He added that the law obligated all public and private media outlets to observe equality, objectivity and impartiality in handling and media coverage of the elections, in accordance with recognized professional principles.

In order to facilitate for the candidates, a group of halls in sports clubs and youth centers in various areas of the country has been identified to hold meetings and seminars for free. They were provided with all technical requirements, taking into account the current health conditions due to the coronavirus pandemic and to ensure the application of precautionary measures.

Brig. Abdullah Khalifa Al Muftah noted that Media Committee is fully prepared to provide assistance to the candidates, noting the free media services provided by the Qatar Media Corporation to all candidates to review their electoral programs and communicate with voters through the various media outlets. 

For his part, Mohammad Sarie Al Kaabi, representative of Qatar Central Bank and member of the Committee for Oversight of Expenditure on Electoral Advertising, spoke about controls and requirements that candidates must abide by; including that the maximum expenditure for each candidate on electoral campaigns is 2 million Qatari riyals.

He said that the candidate must determine the sources of funding for his electoral campaign and notify the committee that monitors spending on electoral campaigns with the names of the natural persons from whom he received a donation and the amount of the donation. The total donations should not exceed 35% of the maximum.

According to the law, only donations from Qatari natural persons are allowed, and it is prohibited to receive any support from other foreign or local sources.

He noted that each candidate must deposit all private funds and cash donations in a bank account in the Qatar National Bank designated for electoral campaigns twenty-four hours before the start of the electoral campaign, adding that all expenses are spent on electoral campaigning from the aforementioned account and it is not permissible to spend from any source other than this account.

Al Kaabi added that the candidate must verify the sources of cash and in-kind resources and deposit their amount or monetary value immediately upon receipt into the bank account. He must not to exceed the legally permissible funding ceiling, use the bank account except for the purpose specified for it, or use it for any purposes or business related to the candidate personally.

The forum witnessed interventions and questions raised by the candidates about the various stages of the electoral process.

الدوحة: عقدت اللجنة الإشرافية لانتخابات مجلس الشورى في دورته الأولى مساء اليوم ملتقى مرشحي مجلس الشورى الذي سعى لتعزيز الوعي بالعملية الانتخابية في جوانبها القانونية والتنظيمية، وذلك بحضور المرشحين المقيدين في الجداول الأولية.

وسلط الملتقى الضوء على الإجراءات القانونية والتنظيمية المتعلقة بالدعاية الانتخابية ومتطلباتها كما نظمها القانون وكذلك شرح بعض الإجراءات المتعلقة بيوم الاقتراع ومتطلبات لجنة الرقابة على الانفاق على الدعاية الانتخابية.. كما استمع أعضاء اللجنة الإشرافية الى كافة الأسئلة والاستفسارات التي طرحها المرشحون وتقديم الإجابات الوافية لكافة التساؤلات.

وأكد العميد سالم صقر المريخي نائب رئيس اللجنة الاشرافية لانتخابات مجلس الشورى على أهمية هذا الاستحقاق الوطني المهم.. مبينا حرص اللجنة على تقديم كافة التسهيلات للمرشحين والناخبين حتى تتم الانتخابات على الوجه الأكمل.

ونوه العميد المريخي إلى توجيه معالي الشيخ خالد بن خليفة بن عبدالعزيز آل ثاني رئيس مجلس الوزراء ووزير الداخلية، اللجنة للقيام بدورها في التجاوب مع المرشحين والاستماع اليهم وتوضيح كافة الإجراءات المتعلقة بالعملية الانتخابية.

وحول إجراءات الانتخاب، أوضح العميد سالم صقر المريخي انه وفقا للقانون يكون لكل دائرة انتخابية لجنة تسمى لجنة الانتخاب تشكل برئاسة قاضٍ يختاره المجلس الأعلى للقضاء، وعضوين أحدهما من وزارة الداخلية والآخر من وزارة العدل، ويصدر بتسميتهم قرار من الوزير.

وتختص اللجنة بإجراء عملية الاقتراع وفرز الأصوات وإعلان النتيجة في مقر الدائرة الانتخابية.

وأضاف ان القانون نص كذلك على ان الانتخاب حق شخصي لا يجوز الإنابة أو التوكيل فيه وعلى كل ناخب أن يباشر حقه الانتخابي بنفسه في المقر الانتخابي التابع لدائرته الانتخابية.. كما نص على أن يكون الانتخاب بطريق الاقتراع العام السرّي المباشر.

واستعرض العميد سالم صقر المريخي نائب رئيس اللجنة الاشرافية مجموعة من الإجراءات المتعلقة بيوم الانتخاب والطعن في صحة الانتخابات وغيرها من الإجراءات المتعلقة في هذا الشأن.

وحول الدعاية الانتخابية للمرشحين وتوقيتها وضوابطها، استعرض العميد عبدالله خليفة المفتاح رئيس اللجنة الاعلامية باللجنة الاشرافية تلك الضوابط وفقا للنصوص القانونية.

وأوضح أن القانون حدد فترة ممارسة الدعاية الانتخابية لتكون بعد إعلان الكشوف النهائية للمرشحين وتنتهي قبل أربع وعشرين ساعة من بدء عملية الانتخاب.

ونبه إلى أنه لا يجوز القيام بالدعاية الانتخابية في غير الفترة المشار إليها، وان يكون الحد الأقصى لما ينفقه كل مرشح في الدعاية الانتخابية مليوني ريال قطري.

وأشار إلى أن البلديات هي من تحدد أماكن وضع الإعلانات أو الملصقات أو البيانات الانتخابية وتخصص في هذه الأماكن مساحات متساوية للمرشحين.

واكد العميد المفتاح انه طبقا للقانون، يلتزم المرشح عند ممارسة الدعاية الانتخابية باحترام أحكام الدستور، واحترام حرية الغير في إبداء رأيه، والمحافظة على الوحدة الوطنية وصيانة أمن المجتمع، وعدم القيام بأي دعاية انتخابية تنطوي على خداع للناخبين أو استخدام أسلوب التجريح أو التشهير بالآخرين.

كما نبه إلى عدم استعمال شعار الدولة الرسمي أو رموزها في الاجتماعات والإعلانات والنشرات الانتخابية وكافة أنواع الكتابات والرسوم المستخدمة في الدعاية الانتخابية.

كما أشار إلى أن من الضوابط عدم تصميم الإعلان من حيث الحجم والشكل والألوان ليكون مماثلًا لإشارات وعلامات ولافتات المرور أو غير ذلك من اللافتات الرسمية، مع عدم مخالفة الارتفاعات أو المقاييس أو الأبعاد التي تحددها البلديات المختصة.

ومن الضوابط كذلك، التي سردها العميد المفتاح، “ألا تعيق وسيلة الدعاية الانتخابية حركة المرور أو سير المشاة أو تؤدي إلى حجب أو تعطيل مهام إشارات المرور الضوئية أو إعاقة وسائل الإنقاذ”، مع ضرورة الحصول على موافقة خطية من مالك العقار أو من يقوم مقامه إذا كانت وسيلة الإعلان ستثبت على عقار غير مملوك للمرشح.

وأضاف “إذا كان الإعلان سيثبت على عقار، فيجب ألا تشكل وسيلة الإعلان خطرًا على المنتفعين بالعقار أو تلحق بهم أضرارًا أو تقلق راحتهم، كما يجب ألا تعيق وسيلة الإعلان الرؤية أو تسد منافذ التهوية”.

وذكر أن من الضوابط التي حددها القانون “ألا يؤدي تثبيت وسيلة الإعلان إلى إلحاق أي ضرر بالمرافق العامة، أو تعريض حياة الأفراد أو الممتلكات للخطر أو التعارض مع الطابع الجمالي للمنطقة أو الإخلال بالمنظر العام”.

وحول محظورات الدعاية الانتخابية، أشار العميد عبدالله خليفة المفتاح رئيس اللجنة الاعلامية باللجنة الاشرافية إلى أن القانون نص على عدد من المحظورات عند ممارسة الدعاية الانتخابية مثل تضمين وسائل الدعاية الانتخابية الدعوة لأي نزعة قبلية أو طائفية أو ما يتعارض مع الآداب العامة أو التقاليد السائدة أو القيم الدينية والاجتماعية للمجتمع.

كما نص على حظر الإساءة إلى أي مرشح آخر أو إثارة النعرات القبلية أو الطائفية بين المواطنين بأي شكل، واستغلال الوسائل والأدوات المملوكة للدولة في الدعاية الانتخابية، والتعدي على وسائل الدعاية الانتخابية للغير بأي طريقة سواء بالشطب، أو التمزيق أو التخريب أو الحجب.

وأفاد كذلك أنه يحظر على المرشح تنظيم وعقد الاجتماعات الانتخابية وإلقاء الخطب، أو وضع الملصقات أو الإعلانات أو الصور في دور العبادة والمراكز الدينية، والمنشآت التعليمية، والمنشآت والمباني والمرافق الحكومية، والمنشآت والمباني ذات الطابع الأثري أو التاريخي والأسوار المحيطة بها.

كما يحظر على المرشح تنظيم وعقد الاجتماعات الانتخابية وإلقاء الخطب، أو وضع الملصقات أو الإعلانات أو الصور داخل قاعة الانتخاب أو خارج المقر الانتخابي بمسافة تقل عن مئتي متر.

ويحظر على المرشح كذلك، وضع الملصقات أو الإعلانات أو الصور على الأشجار أو حاويات النباتات أو العلامات الإرشادية أو الإشارات المرورية.

ووفقا للقانون، لا يجوز استعمال مكبرات الصوت لأغراض الدعاية الانتخابية إلا بترخيص من البلدية المختصة على أن تُراعى الأماكن والأوقات المحددة في الترخيص.

وأوضح ان المادة (27) نصت على انه لا يجوز لأي من العاملين في الوزارات والأجهزة الحكومية الأخرى والهيئات والمؤسسات العامة القيام بأي دعاية انتخابية أثناء مزاولة عملهم أو دوامهم الرسمي.

وطبقا لنصوص القانون يجب على المرشح إزالة الإعلانات والملصقات والنشرات الانتخابية وأي وسيلة من وسائل الدعاية الانتخابية خلال ثلاثة أيام من تاريخ انتهاء العملية الانتخابية.

ولفت العميد المفتاح إلى أن القانون خول الجهة المختصة في وزارة البلدية والبيئة إزالة الإعلانات والملصقات والنشرات الانتخابية على نفقة المرشح بعد إنذاره بذلك خلال الأربع والعشرين ساعة التالية للإنذار كما يجوز لها إزالة أي إعلان يخالف شروط الترخيص على نفقته بعد إنذاره بتصحيح المخالفة وذلك خلال الأربع والعشرين ساعة التالية للإنذار.

وذكر أن القانون ألزم كافة وسائل الإعلام العامة والخاصة مراعاة المساواة في التعامل الإعلامي بين جميع المرشحين وأن تراعي الموضوعية والحياد في التناول والتغطية الإعلامية للانتخابات بوجه عام وفقًا للأصول المهنية المتعارف عليها.

واكد رئيس اللجنة الإعلامية انه من اجل التيسير على المرشحين تم تحديد مجموعة من الصالات بالأندية الرياضية والمراكز الشبابية المنتشرة في مختلف مناطق الدولة لعقد اللقاءات والندوات مجانا مع تجهيزها بكافة المتطلبات الفنية وذلك مراعاة للظروف الصحية الحالية بسبب جائحة كورونا وضمانا لتطبيق الإجراءات الاحترازية.

كما بين انه يمكن للمرشح حجز قاعات في الفنادق على نفقته الخاصة لعقد اللقاءات والندوات مع الالتزام بالإجراءات الاحترازية.

وأضاف ان اللجنة الإعلامية على اتم الاستعداد لتقديم المساعدة للمرشحين، منوها بالخدمات الإعلامية المجانية التي تقدمها المؤسسة القطرية للإعلام لكافة المرشحين لاستعراض برامجهم الانتخابية والتواصل مع الناخبين عبر مختلف الوسائط الإعلامية التابعة للمؤسسة.

من جانبه، تحدث السيد محمد سريع الكعبي ممثل مصرف قطر المركزي وعضو لجنة الرقابة على الانفاق على الدعاية الانتخابية، عن ضوابط ومتطلبات يجب ان يلتزم بها المرشحون منها ان يكون الحد الأقصى لما ينفقه كل مرشح على الدعاية الانتخابية 2 مليون ريال قطري.

وقال إن على المرشح تحديد مصادر تمويل دعايته الانتخابية واخطار لجنة الرقابة على الانفاق على الدعاية الانتخابية بأسماء الأشخاص الطبيعيين الذين تلقى منهم تبرعا ومقدار التبرع، وألا يتجاوز إجمالي التبرعات نسبة 35 % من الحد الأقصى.

وأضاف “طبقا للقانون يسمح بالتبرعات من الأشخاص الطبيعيين القطريين فقط ويحظر تلقي أي دعم من مصادر أخرى أجنبية أو محلية”.

وأشار إلى أنه يجب على كل مرشح قبل أربع وعشرين ساعة من بدء الدعاية الانتخابية إيداع جميع الأموال الخاصة والتبرعات النقدية في حساب مصرفي ببنك قطر الوطني المخصص للدعاية الانتخابية.. منوها إلى أن “جميع النفقات تصرف على الدعاية الانتخابية من الحساب المذكور ولا يجوز الإنفاق من أي مصدر خارج هذ الحساب”.

ونبه إلى أن مصروفات الانفاق تسدد بناء على وثائق اصلية على شكل فواتير وسندات مؤرخة ومعتمدة من الموردين ومقدمي الخدمات.. مبينا أن عمليات الإيداع والسحب والتحويل من الحساب تنتهي بعد ثمان وأربعين ساعة من تاريخ الإعلان عن نتائج الانتخابات ويكون إغلاق الحساب المصرفي بناء على اخطار من اللجنة للبنك.

وأكد السيد الكعبي أن على المرشح وخلال خمسة عشر يوما من تاريخ الإعلان عن نتائج الانتخابات الانتهاء من تقديم بيان حسابي لدعايته الانتخابية معتمد من مدقق حسابات.

كما أوضح أنه يجب على المرشح التحقق من مصادر الموارد النقدية والعينية وايداع مبلغها او قيمتها النقدية فور قبضها بالحساب المصرفي، وعدم تجاوز سقف التمويل المسموح به قانونا، وعدم استخدام الحساب المصرفي لتمويل الحملة الانتخابية إلا في الغرض المحدد له، ولا يتم استخدامه في أي أغراض او أعمال تخص المرشح بشكل شخصي.

وشهد الملتقى عددا من المداخلات والتساؤلات التي طرحها المرشحون حول مختلف مراحل العملية الانتخابية.
